Agreement to These Terms

These Terms of Service (“Terms”) govern your use of buildwithpremierswfl.com (the “Site”), operated by Premier Home Builds (“Premier Home Builds,” “we,” “us” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Purpose of the Site

The Site provides general information about Premier Home Builds and our residential construction services in Southwest Florida, including general contracting, new home construction, custom homes, floor-plan homes, lot and home packages and remodels and additions. The Site also allows you to contact us and request a consultation.

Informational Content Only

The content on the Site is provided for general informational purposes. It is not professional, legal, financial, insurance, engineering, real estate or tax advice. Building codes, flood maps, permitting requirements, utility availability, environmental rules and other regulations change over time and vary by property and jurisdiction. Before making decisions, you should consult the appropriate government agencies and qualified professionals about your specific situation.

Any descriptions of costs, timelines, processes, features or requirements on the Site are general in nature. They are not quotes, offers, guarantees or commitments. Examples and comparisons on the Site are hypothetical illustrations and do not describe specific properties or projects.

No Contract Created by Use of the Site

Submitting a form, sending an email or calling us does not create a contract, a contractor-client relationship or any obligation on either party. Any construction services we provide will be governed solely by a separate written agreement signed by you and Premier Home Builds. If there is any conflict between these Terms and a signed construction agreement, the signed agreement will control.

Estimates and Pricing

Preliminary budgets, estimates or price ranges we discuss with you are based on the information available at the time and are subject to change. Final pricing is provided only after design, specifications, selections and site evaluation are complete, and is set out in a written construction agreement.

Floor Plans, Images and Renderings

Floor plans, square footages, illustrations, renderings, animations and photographs on the Site are for illustrative purposes. Actual homes may vary in dimensions, materials, features, finishes, elevations and appearance. Square footage figures are approximate. Plans and specifications are subject to change without notice and may need to be modified to meet site conditions, code requirements, community standards or engineering needs.

Licensing

Construction services are performed in accordance with applicable Florida licensing requirements. You may verify contractor licensing through the Florida Department of Business and Professional Regulation.

Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

• Submit false, misleading or fraudulent information through our forms
• Use the Site to send spam or unsolicited messages
• Attempt to gain unauthorized access to the Site, its servers or any connected systems
• Interfere with or disrupt the operation or security of the Site
• Use automated tools to scrape, copy or harvest content or data from the Site without our permission
• Use the Site in any way that violates applicable laws or regulations

Intellectual Property

All content on the Site, including text, graphics, logos, floor plans, images, animations, designs and the overall look and feel of the Site, is owned by or licensed to Premier Home Builds and is protected by copyright, trademark and other laws. You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works from or use our content for commercial purposes without our prior written permission. Our floor plans may not be used to build a home without a written agreement with Premier Home Builds.

When you submit information through the Site, you represent that it is accurate and that you have the right to provide it. Our use of personal information is described in our Privacy Policy.

Any warranty for construction work will be set out only in a signed construction agreement.

Limitation of Liability

To the fullest extent permitted by law, Premier Home Builds and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from or related to your use of, or inability to use, the Site or its content, even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless Premier Home Builds and its owners, employees and agents from any claims, damages, losses or expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated Terms.
